The Children’s Court Lawyers
The Children’s Court is a specialist jurisdiction that deals with criminal offences where an accused person is under the age of 18 years, or was at the time of offending. The Children’s Court, in it’s criminal jurisdiction, deal with the following types of matters:
Criminal cases such as assaults, robberies and drug matters;
Some traffic matters; and
Related applications, such as forensic procedures (like the taking of DNA), and parole.
Traffic matters are only dealt with by the Children’s Court where the young person is not old enough to hold a licence, or where other criminal charges remain in the Children’s Court. If the young person is old enough to have a licence, the matter will be dealt with in the Local Court of NSW.
Some types of very serious offences (such as murder or serious sexual assaults) that are committed by young people start in the Children’s Court before being transferred out to the District Court or Supreme Court for finalisation.
The criminal process in the Children’s Court is much the same as within the Local Court of NSW but with some distinct differences that require specialist care and attention.
